In an unusual legal case, an IT employee who had been on sick leave for 15 years sued his employer, IBM, over a pay dispute—claiming discrimination for not receiving a salary increase during his extended absence. The court ultimately dismissed his claim, highlighting the unique nature of the benefits he received.

The story revolves around Ian Clifford, a software professional in the UK, who went on sick leave from IBM in September 2008 due to mental health issues. Over the years, his condition was diagnosed as serious, and he remained absent from work.

In 2013, after five years away from the office, Clifford filed a formal complaint, criticizing the fact that his salary had remained frozen throughout his leave. At that time, IBM and Clifford reached a settlement, placing him on the company’s Sickness and Accident Plan. This plan guaranteed him 75% of his last drawn salary until he retired, which, based on his salary then, amounted to over £54,000 annually—potentially over £1.5 million until retirement.

This arrangement included additional payments to settle holiday claims, effectively providing Clifford with a lifelong, secure income stream without working. He agreed to settle the matter and close his case.

However, nearly a decade later, in 2022, Clifford filed a new lawsuit, this time alleging disability discrimination. He claimed that IBM’s failure to increase his fixed annual payments in line with inflation was discriminatory, arguing that his income’s purchasing power was eroding due to rising prices.

The employment tribunal dismissed his case in 2023. The judge clarified that the lifelong payment plan was a “very substantial benefit” and a form of “favourable treatment” exclusive to disabled employees. The court emphasized that such benefits are not comparable to regular salary increments and that Clifford’s benefit was a special privilege.

A key excerpt from the ruling stated that the employee could not claim discrimination merely because he did not receive additional benefits beyond the exclusive arrangement tailored for him.

The court viewed the guaranteed annual payments not as a frozen salary but as a protected financial support system, inherently a privilege granted under special circumstances.

This case underscores the complex boundaries between employer benefits and employee rights, especially in cases involving long-term disability and exceptional support arrangements, leaving many to ponder the unusual twists in workplace legal battles—particularly in India’s highly competitive IT sector where salary hikes and appraisals are fiercely contested.
